Terms and Conditions
By using this site, or ordering from it, you acknowledge
that you have read, understood, and agree to be bound
by Xoverclockers policies. Please review our terms and policies.
Our Privacy Policy
Xoverclockers does not sell or give out our customer's
information to anyone, period.
Payment
Payment Terms; Orders; Interest. Advertised prices
are in U.S. Dollars and, unless otherwise noted,
exclude shipping, handling and any taxes that may be imposed
by the legal authority that
governs the jurisdiction in which you reside. Terms
of payment are within Xoverclockers’ sole discretion, and unless otherwise agreed
to in writing by Xoverclockers, payment must be received by Xoverclockers
before Xoverclockers’ acceptance of an order. Invoice amounts
are due and payable within the period noted on this
invoice, measured from the date of the invoice. Xoverclockers
may invoice parts of an
order separately. You agree to pay interest on all
past-due sums at the highest rate allowed by law.
Shipping and Title
Xoverclockers will arrange to ship
the product(s) you purchase to you. Title to the product(s)
passes to you when Xoverclockers delivers it to the
carrier and risk of loss passes to you when the shipper
delivers product(s) to the address you designate. Title
to software remains with the licensor of the software.
Your use of software is subject to license agreements
applicable to the software. You must notify Xoverclockers
of missing or damaged items in your order within five
(5) days after you receive your product.
Warranty
Items purchased from Xoverclockers come with a 30-day warranty against manufacturer
defects only. The 30-day period starts when you receive delivery of the item
(as specified by Delivery Confirmation). The warranty applies to the original
purchaser only. After the 30-day warranty is over, the manufacturer should
be contacted directly for repair or replacement. Our warranty does not apply
to any items that have been modified or abused. Please note that items are
not warranted as to compatibility with your current components in regards
to use, fit, or utility. Xoverclockers reserves the right to repair or replace
defective items under warranty as we see appropriate.
Pricing
Prices are subject to change without notice. The price
you pay is set at the time you order. We cannot offer price protection
in any way. All prices are listed in terms of US currency.
Product Returns
No exchanges, refunds, or returns will be accepted
past our 30-day warranty.
To initiate a return or
replacement for a defective product you must request an RMA number.
After you email us your order number and the reason
for return we will then give you an RMA number that
is good for 10 business days. Any return without an RMA number or that
has an expired RMA number
will be refused and returned at the customer's expense.
We are not responsible for lost RMA packages sent back to us, so please
insure your package.
Exceptions to Our 30 Day Return Policy
Water cooling
related products, or items modified at customer’s
request will not be accepted back once sold.
Defective
Items
If you have received a defective product from Xoverclockers.com,
you may return it to obtain a credit, exchange, or
refund excluding shipping. DOA or defective products
must be reported to us within 48
hours (based on Delivery Confirmation) of receiving the
products.
Non-Defective Items
Xoverclockers.com reserves
the right to assess a 15% Restock fee on returned non-defective
items. Note that shipping,
handling, or any labor charges are not refundable.
Refund amounts will be based on your orders invoice
at the time of purchase.
Any non-defective products
returned to Xoverclockers incomplete or altered from
its original condition (missing screws, grease, etc),
not in a resalable condition (dirty, missing boxes or paperwork), will
be refused and returned at the customer's expense.
Limitation
of Liability
All products sold on this website are to be used at
your own risk. Under no circumstances is Xoverclockers liable for the
following: (1) Third Party claims against you for damages; (2) personal
injury, loss of or damage to your records, data, or equipment; (3)
economic consequential damages (including lost profits, lost data,
or lost savings), or incidental damages even if we are informed of
their possibility.
Software and Peripherals. Any warranty and technical
support provided on third-party products offered by
Xoverclockers, such as computer monitors, speakers and other peripheral
devices, as well
as software, are provided by the original manufacturer
and not by lockers. The warranties and technical support offered by such
manufacturers may
vary from product to product. Xoverclockers-branded
software and peripheral devices carry the same warranty terms as those
described in Section 6.
Not for Resale. You agree and represent that you
are buying the products
governed by this Agreement for your own use and not
for resale. Xoverclockers has separate terms and conditions
governing resales and transactions
outside the United States.
